This audio tape should be played in every middle school across the country. This is what happens when you steal. You beg for your life and then you die getting shot up. This would be a lot more effective in curbing crime than any amount of "Head Start" initiatives.

Trespassing should be punishable by death? It's pretty clear that the main crime here is manslaughter (arguably even second degree murder).

From the alleged facts, this paints the guy a murderer:

- He knew that the youths in the neighbourhood engaged in "garage hopping"
- He stated that he'd shoot a youth
- He left the garage door open
- He shot three times and, after a relatively long pause, a fourth time.

Premeditation, intent, planning - the hallmarks of a murder.

I prefer to call it "active defense." Let's remember something quite important here - if the scum didn't try to steal he would still be alive. That's the message that I think we should be sending to the youth of the country. If you want to live - don't take other people's stuff.

I would be very annoyed if we deterred people from defending their home and property. Hopefully the guy will get off - but you never know in today's justice system. Just out of curiosity, would you believe it to be just if a shop keeper to throttled your child to death if he/she was found to have pocketed a candy-bar? What if your kid was killed for chasing his ball, or the family pet into this home owner's garage? Should the audio of the last breaths of your dying child be played in schools across the country?

I don't see why you like contorting the situation into something that it is not. Razor says that he wast here to steal. He died for it. This is why its important to be sent out a public service message. What is the harm? Do you want more petty thieves dead because they didn't have a healthy dose of fear of breaking and entering?

Do you want more exchange students dying? If you don't why wouldn't you want to create this public service message for school age children? The fewer 'petty thefts' that take place the fewer homeowners there will be shooting criminals. Seems like the best way to prevent this 'tragedy' is to make sure the lesson of "you steal you could die" is set at an early age.

You're still being too lenient. That GOP Congress-critter from the last election cycle had it right. Parents should have the right to kill their children for being disobedient. Spare the rod and spoil the child after all. That would work. That would instill sufficient fear wouldn't it Lewk?

In January, Rodrigo Diaz, his girlfriend and two others pulled into a Gwinnett driveway to pick up a friend to go skating. Unknown to them, it turned out to be the wrong driveway, the driveway of Phillip Sailors.

As part of the plea deal cut by Gwinnett County District Attorney Danny Porter, Sailors was charged a $500 fine and given a year’s probation, an outcome that the Diaz family supported.


“There is no point for him to be in lifetime in prison,” Diaz’ brother David said . “What we get from that? Nothing. Like my dad said, we don’t hold any grudge.” (The Diaz family had earlier negotiated a settlement in civil case filed against Sailors and his insurance company.)


I admire the forgiveness demonstrated by the Diaz family, but I cannot say that I entirely share it. As David Diaz noted, putting an elderly Vietnam veteran such as Sailors into prison for the rest of his life does no one any good, but a small fine and probation sends a dangerous message of its own. It minimizes the gravity of what occurred and contributes to the sense that Sailors did nothing all that wrong, and that others in similar situation can act in a similar manner.


I’m sorry: You do not have the right to shoot someone who pulls into your driveway by mistake. If you pull a gun on someone and use it in a recklessly fatal manner, shooting and killing an innocent person as they attempt to flee your property, as the police reports allege Sailors did, you should not get off pretty much scot-free. Using a gun on someone is serious, serious business.


Furthermore, your own misguided fear is no justification and no excuse for ending the life of another human being. As an adult, you are responsible for how you handle that fear and how you act upon it. When you choose to pick up a firearm, you become responsible for the consequences, and when you make a series of conscious decisions that end with you taking the life of an innocent person, you should face the consequences.


For the mistake of pulling into the wrong driveway, Rodrigo Diaz paid with his life. For the mistake of shooting Diaz and taking his life, Phillip Sailors paid a $500 fine.


That’s not justice.

Actually, Latino is considered an ethnicity, not a race. All the affirmative action questionnaires have separate "white Hispanic" and "non-white Hispanic" categories (e.g. Cubans tend to self-identify as white, while Dominicans do not).
