I'd say: Unlawful killing. A case for accidental killing could be made if the perpetrator was killed by a gun (just takes a pull of the trigger and the deed is done) - but if he was actually throttled, that's a completely different matter. Throttling is, after all, not instantly lethal.

Yes. I'm assuming that was what happened, since if it was pure suffocation, the victim would have fallen unconscious and stopped struggling well before death. That's making the optimistic assumption that the throttling stopped when the "struggling" did.

My kid stole a pack of gum from the grocery store once. Then I told him he'd be chased down and killed, strangled in an alley, because that's what we do with petty thieves in America. Sure did the trick to teach him what's right and wrong. Yessirree.

He likes the fact that a criminal has been killed, and he likes the outrage that causes in us.
