Those amendments restrict what government actions can be taken against US citizens. This is also why when the military operates they don't need to worry about the 4th amendment. When we detain enemy combatants we don't have to worry about the 8th amendment. Show me the court case where the SC has ever ruled otherwise when it comes to the bill of rights applying to non-citizens.
