That's nothing more than a matter of timing. The day after SCOTUS rules that was a mistake, the Californian Congress can re-introduce a Hollingsworth 2.0 piece of legislation and start passage on a new legislative ban.

How many States have legalised equal marriage based on court rulings rather than leglislation. Do you really think Kennedy is willing to overturn all that precedent?

Hence the problem with relying on courts instead of the legislative process.
