There are those who say that he simply can't. There are others who say that the courts have historically often upheld blatant violations of similar rights, and that it's all about what you have the power to get away with. Regardless, win or lose, this will rile up the base against the institutions that serve to check the worst impulses of an otherwise utterly repugnant govt.
