It isn't (except for prison contractors ) but I think you can argue that a judicial system has a responsibility to work towards the overall betterment of society and that's hard to do if you forbid cost-benefit considerations.

And making sure innocent people aren't sentenced to death counts as "overall betterment of society" to me, by the way.
