    Political bias notwithstanding, Nathan Robinson writes some very good articles.

    The existence of a “he said, she said” does not mean it’s impossible to figure out the truth. It means we have to examine what he said, and what she said, as closely as possible. If both parties speak with passion and clarity, but one of them says many inconsistent, evasive, irrational, and false things, while the other does not, then we actually have a very good indicator of which party is telling the truth. If a man claims to be innocent, but does things—like carefully manipulate words to avoid giving clear answers, or lie about the evidence—that you probably wouldn’t do if you were innocent, then testimony alone can substantially change our confidence in who to believe.

    Briefly, let’s look at two more ways in which Kavanaugh massaged facts about the event itself in order to make Christine Ford’s claim seem impossible and treat Ford as completely detached from reality. Have a look at what he does here:

    I did have the summer of 1982 documented pretty well. The event described by Dr. Ford, presumably happened on a weekend because I believed everyone worked and had jobs in the summers. And in any event, a drunken early evening event of the kind she describes, presumably happened on a weekend. If it was a weekend, my calendars show that I was out of town almost every weekend night before football training camp started in late August. The only weekend nights that I was in D.C. were Friday, June 4, when I was with my dad at a pro golf tournament and had my high school achievement test at 8:30 the next morning.

    Kavanaugh quickly tries to restrict the range of possible dates to weekends, and on weekends he largely has alibis. “Presumably” this event happened on a weekend he says, because they were hard-working kids and drinking wouldn’t happen on a weeknight. But he actually has precisely such an event on his calendar! The July 1st brewski-evening with P.J., Judge, et al. happened on a Thursday, according to his own record. Kavanaugh tries to get people to avoid scrutinizing weekdays, by immediately “presuming” that this had to occur on a weekend, when he was—conveniently—frequently out of town. 1982 Kavanaugh has proven clearly that 2018 Kavanaugh is misleading the Senate about how he used to spend his weeknights.

    Yes there's been a series of allegations. The FBI should be given free reign to investigate as they see fit. A neutered investigation is a sham.

    A start would be interviewing all those who've complained and following any leads generated.

    Perhaps most importantly, she does not remember how she got from the party back to her house.

    that the party took place near the Columbia Country Club. The Club is more than 7 miles from her childhood home as the crow flies, and she testified that it was a roughly 20-minute drive from her childhood home.

    She also agreed for the first time in her testimony that she was driven somewhere that night, either to the party or from the party or both.
    o

    Dr. Ford was able to describe hiding in the bathroom, locking the door, and subsequently exiting the house. She also described wanting to make sure that she did not look like she had been attacked.
    o

    But she has no memory of who drove her or when. Nor has anyone come forward to identify him or herself as the driver.
    o

    Given that this all took place before cell phones, arranging a ride home would not have been easy. Indeed, she stated that she ran out of the house after coming downstairs and did not state that she made a phone call from the house before she did, or that she called anyone else thereafter.


    She does, however, remember small, distinct details from the party unrelated to the assault. For example, she testified that she had exactly one beer at the party and was taking no medication at the time of the alleged assault.

    It's been 36 years, she was a girl and she was traumatized. She remembers details that can guide an investigation but Republicans refuse to follow up on them. Kavanaugh repeatedly lied about both his summer as well as his drinking habits, and Republicans refuse to follow up on that too. It's bizarre to see how these swamp-creatures are approaching this.

    Sounds like pretty typical human behavior to me, especially when you look at what they have gained with that behavior. Seems more like the calculus of sacrificing the long term good of the nation, and maybe the whole of humanity, for short term gains. But keep in mind these are people facing the demographic erosion of their power no matter what they do, so they've decided to get everything they can, while they still can, maybe even slow that advancing demographic glacier. It's very rational.

    These base impulses are supposed to be tempered & kept in check by laws, rules, norms, internalized morals, social pressure etc. Where are all those much-vaunted safeguards, those institutional checks, the character of the American public we keep hearing about? This is spineless and pathetic.

    Cap's off ugly in US politics. I don't know why. Ask Fuzzy. He probably knows. Or he'll just say this is nothing new, there's never been a cap or some such.

    EDIT: I suspect the ugly we see today is just the latest in a long slide, probably dating back to the '90s. Or earlier. It's become more and more brazen and nasty, though, largely because of our brazen and nasty president. He's been educating the rest of the GOP in how much one can get away with when one abandon's pretense of principle and flat out owns it.

    In the Ford case I am not so certain I am convinced of its relevance; it seems that both parties have a very different recollection of what transpired. What is more worrying is this piece in the Telegraph about Kavanaugh's past as a legal professional.

    It's bad enough that our president is a chronic liar, with staffers citing alternative facts and fake news to enable "Trump Truthiness". We don't need a sitting judge who lies under oath to be elevated to the highest court. Talk about eroding public trust in important institutions....
