    Sometimes what constitutes child porn can put you in possession of it from a legal standpoint, if not a factual one. I have pictures of my daughters in the tub, does constitute child porn? I don't think so. But others, seeing them out of context, would call the law down on me. This is an easily defended circumstance, but others may exist which are less clear-cut. I don't defend the actions of the real pervs, nor do I wish to make it easier for them to operate. I can't agree with overzealous prosecution of teens who are only exploring their own sexuality. Even if they are being extremely careless and ignorant about it, this is one for the parents to handle, not the courts.

    A valid point. I never really thought about the parent/child bath type scenario.

    Perhaps I should rethink my opinion on this

    a rethink is not neccessarily in order. If I found those pictures in anothers possesion, I'd be out for blood. Fuck the law at that point. But you can't assume that every case is child porn, but you can be suspicous. Even of parents

    Perhaps the quantity of pictures is important too. One pic of baby in bath, nothing much. An album of different babies in baths, time to get ther handcuffs out.

    But yeah, I can see how it's not so black and white as I first thought

    Exactly. You can't be too safe when it comes to kids though, it's scary. my previous posts on this topic have me rethinking as well. It's easy to worry about the balance between giving your children freedom to discover their place in this world and leaving them unprotected. The best you can do is keep the lines of communication and respect going both ways.

    The whole point of making child porn illegal is to prevent the exploitation and damage of children. If some dimwit takes a picture of her own tits and texts it to the football team, its nothing at all like being forced to give a fat old man a blow job. It's a teen doing what teens do best - risky sexual behaviour with no thought of the likely consequences. To put her in fucking jail for that is beyond stupid.

    It's a stupid thing to do (take nude pics of yourself and send them to the object of your affection) but not all stupid acts need to be dealt with by the judicial system. Making a teenage girl into a criminal (in one of the worst categories of offenders) for simply being stupid/naive is not a smart way to go and is unlikely to have any positive outcomes.

    I have issues with the people that forward on said pics, and in some cases no doubt they would end up in the possession of tamps but to prosecute the boyfriend for having a picture of his girlfriend which she "chose" to send him under no duress - that's just a waste of valuable resources.

    Ok, at this exact moment I think I am the only grandparent on this board. Having said that, believe me when I say...some sick fuck takes pics of my adorable granddaughters, (clothed or naked) for sexual gratification...they be a dead sick fuck!!

    Now, when Bug gets older, gets a phone, and sends titty or pussy shots to her current fling, meh, whatever.

    I am trying to remember what newspaper I read the article in, but somewhere in Colorado a Dad WAS prosecuted for taking the bare butt on the bear rug pics. Gotta give me a bit to remember where, cause this last week ain't not been sober...sorry!

    Basically, if the teen took and distributed their own pictures, there should be no prosecution unless it is suspected that they took the pictures while being coerced by another teen or an adult. Then the other party should be prosecuted, though this is admittedly kind of murky if its just you and some friends screwing around. Maybe tacking on something about intent to cause harm or to materially profit from said pictures on the part of either party (photographer or coercer)? A recipient of the initial sext message who forwards the picture on to others who were not intended as recipients could perhaps be prosecuted under this framework.

    As it stands right now, some of these cases take the form of "I took a picture of myself when I was 15 and now I'm a sex offender." And that's pretty stupid and extremely harmful to the kid. There should be (and I know in the US there is) some effort to make teens understand the possible social repercussions of sexting and to educate parents about this as well. But charging a 15 year old for child pornography because they took a picture of their own body and sent it to their crush-of-the-moment? No way.

    There's also a problem with... I'm not sure what the right word is here... devaluing? the 'sex offender' label. If kids keep getting prosecuted for things like this then eventually the term will lose any usefull meaning. What happens when you get warned about a sex offender in your neighbourhood and the natural response is "so what, did s/he got caught making out with his/her girl/boyfriend when s/he was 18?" because by now everybody is a sex offender.

    Well, the only picture of me as a baby that survived the rather tumultuous separation of my parents is exactly such a picture. Taken about 45 years ago now. I am pretty certain that that picture wasn't taken to gratify anybody's sexuality, but I am pretty certain there must be somebody somewhere in this world who could get his rocks off with it.

    Really I think that every picture, even of a sexual nature, should only be seen within its context. Teenagers doing this kind of thing are doing that in a certain setting; in that setting they should be sat down and told of the risks of doing this kind of thing; the internet, use by child pornographers. What they should not be confronting is a judge on the basis of a law that was intended to fight abuse of teenagers, not adding to it by putting them in jail for harming nobody but potentially themselves.
