On the face of things, it seems to me the lower courts are correct (and it would seem to me to be a classic "standing" issue). The right course of action would be to agree to Mexico's request for extradition. But the US government is never going to agree to extradite a LEO for something related to their duties even if it was grossly out of line, which shooting a child because you were fed up with his game definitely is.
