    Default No Charges...

    https://www.dallasnews.com/news/elli...iminal-charges

"Prosecutors have decided not to file criminal charges against a Grapevine woman who falsely claimed that she was sexually assaulted by a state trooper last weekend.

Sherita Dixon-Cole's allegations drew widespread attention after they were shared on Twitter by prominent columnist and activist Shaun King, who has since deleted the tweet.

A statement from attorney Lee Merritt, who has since apologized for magnifying the allegations, said Dixon-Cole had accused the Texas Department of Public Safety trooper of making sexual advances and sexually assaulting the woman after stopping her in Ellis County on suspicion of driving while intoxicated."

Pathetic. They absolutely could have charged her with a crime. Hopefully the DUI case at least gets her good, and frankly with the level of malicious depiction she participated in should be a warning sign to everyone who knows her personally and professionally.

I wonder if she's read the story about the boy who cries wolf? Because she's just created a situation where no one will EVER believe an accusation of rape coming out of her mouth again.

Lewk, did you even read your own story?

The office concluded that Dixon-Cole's claims "do not constitute a false report to a peace officer" because they were made to either detention officers or to a private citizen over a recorded jailhouse phone line.
She wasn't charged because she didn't break the law. Lying in itself isn't illegal. If it was, a certain world leader would be serving a life sentence of biblical proportions.

I tried telling him as much in his "Another Hoax" thread.

Lewk, please stop starting new threads every time you hear/read about someone making false claims! Seriously

"It also said the claims "did not create a situation, either real or false, in which there was imminent danger of serious bodily injury or imminent danger of damage or destruction to property.""

The guy received a ton of death threats afterwards. Sounds like imminent danger. And honestly that seems like a decision for a jury.

If you took every social media threat literally and seriously, you'd overwhelm the judicial system. And you're all about a small government footprint, right?

You need both factors. That she didn't lie to a peace officer is an unambiguous fact. Why waste taxpayer money?

That isn't what is required to bring charges. Just like yelling fire in a crowded theater creates an imminent danger, similar situation exists here.

Does it surprise anyone that Lewk is out for blood here, but advertises for "conservative" shows that give airtime to shit like pizzagate or sandy hook conspiracies?

What was the imminent danger? Was someone in danger of spontaneously combusting from reading a tweet?

The risk that someone might get angry enough to send a poorly considered angry response tweet does not count as imminent danger.

This woman is scum of the earth, but you can't bend the law that far just to lash out at someone you don't like.

Sandy Hook conspiracy theories and Pizzagate are not at all things that mainstream conservatives think are real things.

I apologise then for giving your previous shares to much credit.

There is no plausible comparison to yelling fire in a crowded theater or anything equivalent to that. At most, if she named the officer, you might get a defamation suit out of it.
