But Kennedy let himself be convinced he could retire because Trump admired his legacy, and I agree with GGT that this Court has dismantling a bunch of other "it's MY body and MY life" protections on their agenda. Material largely relying on jurisprudence written by Kennedy. Although, oddly enough, abortion itself is probably where he waffled the most himself

    I was reading on how Alito's draft opinion unexpectedly uses jurisprudence based on substantive due process, something which is normally anathema to his wing of the Court. That explains the emphasis on why this ruling should not be taken to create precedent outside of abortion, they don't want to see substantive due process elsewhere. But they have little reason to use substantive due process here in the first place, it's not necessary to overturn Roe. It or something similar might be required if they want to clear the road for using judicial authority to ban all abortions throughout US jurisdiction via declaring laws permitting abortion to be a violation of the protection against deprivation of life without process of law. All kinds of a stretch and itself bad law but. . . there's really no discernible reason for Alito to be endorsing substantive due process.

    Louisiana is now trying to define life as starting at fertilization, not conception. Wants to ban most forms of birth control. Oh, they also want to criminalize miscarriages as a felony murder, which means those women won't get to vote after a conviction.

    This isn't about protecting a life, this is about controlling women.
