    "Mayor Eric Adams on Thursday stood up for the “hard-working” Manhattan bodega clerk languishing on Rikers Island on $250,000 bail after he fatally stabbed a violent ex-con while trying to fend off an attack.

    “My heart goes out for this hard-working, honest New Yorker that was doing his job in his place of business, where a person came in and went behind the counter and attacked him,” Adams said about 51-year-old Jose Alba.

    Prosecutors with Manhattan District Attorney Alvin Bragg’s office charged the dad of three with second-degree murder in the fatal stabbing of Austin Simon, 34, at the Hamilton Heights corner store Friday.

    Alba’s family insists he was acting in self-defense when he grabbed a knife to fight off Simon inside the Hamilton Heights Grocery. Surveillance footage showed Simon storming behind the counter, where he menaced and assaulted the employee."

    "Alba’s daughter, Yulissa, doubled down on the self-defense argument, telling The Post Wednesday: “It was either him or the guy at the moment.”

    She added, “He’s never hurt anybody. He’s never had an altercation where he had to defend himself. This is the first time for him.”

    The employee was captured in the shocking video tending to customers while behind the counter at the Hamilton Heights Grocery store on Broadway, where he was suddenly confronted by the much younger former offender.

    Simon — who was on parole and had at least eight prior busts, including for assault, according to sources and records — then shoved him into a shelf, the video shows. After several moments, Alba reached to the area where candy is stocked, pulled out a knife and plunged it into Simon’s neck and chest."

    Its insane how anti-self defense the left is. First Rittenhouse and now this case. In both cases there is video proving beyond any doubt that it was an act of self defense. These DAs are awful awful people.

    "Still, Simon’s ex-wife said the viral security camera video that shows Alba holding the bloody knife doesn’t tell the whole story.

    “He’s not the monster that they’re trying to make him seem like,” said Simon’s ex-wife, Tiana, 32, who did not want her last named used to protect herself from the public outcry over the case. “Everyone is judging him on a clip of video.”

    "After weeks of mounting pressure, the Manhattan district attorney on Tuesday morning dropped a murder charge against a bodega clerk who fatally stabbed an attacker.

    Jose Alba, 61, killed Austin Simon, 35, on July 1. Mr. Simon had gone behind the counter at the Harlem bodega and shoved Mr. Alba after he had argued with Mr. Simon’s girlfriend over paying for snacks for her 10-year-old daughter. Police investigators said that Mr. Simon was not armed.

    The district attorney, Alvin L. Bragg, charged Mr. Alba with second-degree murder, spurring the city’s tabloids — and, eventually, Mayor Eric Adams — to come to the clerk’s defense.

    Mr. Bragg and his office were criticized for initially requesting a $500,000 bail, which prosecutors said they asked for because Mr. Alba had been planning to leave the country. But Mr. Alba’s supporters said that he was defending himself from a younger man who was the aggressor and should not face charges.

    In a motion to dismiss the case filed Tuesday morning, the district attorney’s office said that it would be unable to “prove beyond a reasonable doubt that the defendant was not justified in his use of deadly physical force.” The case will not be presented to a grand jury.

    Mr. Simon’s family spoke with the district attorney’s office Tuesday morning and condemned the decision."
