I don't find this bad news about free speech, while I have quite often in the past on issues brought up here. Harrassment in this instance has nothing to do with free speech.

How can you harass someone who's dead?
Hope is the denial of reality
No, it exists as a silly ideal in some people's heads. As does communism or capitalism.
And then, when people inevitably go: "But this goes against the ideal of blah!", well, that's tough shit, but what do they expect? Idealism is nice and all, but when you fail to consider reality, that's when it becomes quite ghastly.
He did not harass the dead. He harassed their kin.

And watered heaven with their tears:
Did he smile his work to see?
Did he who made the lamb make thee?
By harassing, you mean posting a message on a tribute thread? Seriously? Your standards are that low? Maybe we should jail Cain for being mean to Tear over his kidney.
Hope is the denial of reality
Not to mention the "several" pictures videos and messages were spread out over "several" dead kids. There's nothing to suggest he repeatedly targeted anyone in particular, but just went from one dead twit on Facebook to another.

Of different people. You've probably made far more offensive posts here than that guy. Should you be jailed? Do you really want offensiveness to be punished by jail time?
What if I stand in the center of your town and on three seperate occasions say "he's an idiot" when you walk past. Jailable offense?

Good fences make good neighbors?
Your parents have an expectation of people not to trespass. But I bet once someone does, they might consider it.
Online, in a public social site, not so much of an expectation. Especially when you let any douchebag see it.
How about if you don't want douchebags screwing with your Facebook page you make it private? This gonna sound like blaming the victim, but why on earth would you advertise the death of a family member on a public feed like this, knowing that their are trolls everywhere? This was served up to the public, almost begging to be targeted by a twat.
OMG I used naughty words...I hope the Bobbies don't come for me.

The irony is that Khen would be attacking Lewk if Lewk said some violent felon needed to be punished (instead of rehabbed) for their behavior. I guess trolling is worse than violence.

Have fun trying to find such an instance. Unless you're telling me that you're for the death penalty if someone steals tooth paste?
My dear, you're saying stuff about me that simply is not true. Maybe you should work on your reading comprehension?
To make it crystal clear: I never said that violent offenders should not be punished, or, in case of mentally ill people, locked away in a psychiatric ward where they would be treated.
Why exactly is it that we must make everything private just so the trolls cannot run amok? Fences everywhere, just so no one can take a dump on our garden? Mistrust anyone and everything just because some moron might come along?
Instead of punishing people for their anti-social behavior? And, before you or someone else bring up this site again, please also consider that moderation on this site is non-existent. Dread is trolling himself, Wraith only appears every full moon and Rand also is not exactly what I would call an active moderator.

Yes, cause they are legion (and vote Democrat).
If I want a pool in my backyard I need a fence cause of morons.
If I want to post personal info on my Facebook page I may want to make it friends only...which is what is recommended by Facebook and anyone with a lick of sense.
Again, 18 weeks for being an asshat??? Really?

No, Loki, several messages to the same person and also other incidents involving different people. In any other medium, his behavior would have gotten him gaoled for harassment or abuse, so I'm not really sure why they face he used the Internet instead of making abusive phone calls, shouting abuse verbally should somehow magically be protected under freedom of speech.

No so much not reading wrong as failing to read beyond the the first two clauses.
[any person who does any of the things we mentioned before] is guilty of an offence if his purpose, or one of his purposes, in sending it is that it should, so far as falling within paragraph (a) or (b) above, cause distress or anxiety to the recipient or to any other person to whom he intends that it or its contents or nature should be communicated.

Remind me what the typical punishment for anti-social behavior in Britain is. 18 weeks in jail, right?
I believe the equivalent would be to go to a funeral, and when given the chance to speak, to say that the dead person was a rotten man. That should be punishable by jail, right?
How about if I'm about to fire some of my employees, and to rub it in, send them an email telling them that they're fired and will probably starve to death. That should be illegal, right?
Humans are petty creatures. What that law does is criminalize a huge portion of human behavior.

Define anti-social behavior. Kicking over some dustbins? I'm guessing no. Harassment, on the other hand, has exactly the same maximum punishment as the Malicious Communications Act: 6 months in gaol.
If you really think that's the equivalent, then you're a moron. I don't know why we even need to come up with any kind of "equivalent" when we can just look at what he said and pretend he did it verbally or IRL instead of on facebook.I believe the equivalent would be to go to a funeral, and when given the chance to speak, to say that the dead person was a rotten man. That should be punishable by jail, right?
"The alcoholic posted a YouTube clip called Tasha The Tank Engine, with Natasha’s picture on an animated train."
Ok, so instead of putting the clip on youtube, he puts it on a big TV somewhere in public where he knows the deceased victims can see it.
"Duffy, 25, also created a Facebook page called Tasha The Tank Engine after the girl was found on a railway line near her Worcestershire home in February."
I'd say this was equivalent to taking out an ad to that effect in a local paper.
"He wrote ‘I fell asleep on the track lolz’ and ‘spoilt dead c***’ on an official memorial page set up by her brother, James."
So, instead of standing up at a funeral, saying the deceased was a rotten person he says they are a spoiled dead cunt who feel asleep on the tracks.
You think that behavior wouldn't get you arrested IRL? Why should online be different?
It is illegal. How about if I'm about to fire some of my employees, and to rub it in, send them an email telling them that they're fired and will probably starve to death. That should be illegal, right?
Just like all laws.Humans are petty creatures. What that law does is criminalize a huge portion of human behavior.

Well, when you get sentenced to jail because someone doesn't like what you said, do be sure to tell us. I'll visit and bring you a carton of fags, so you can buy protection from the fags.![]()

Steely's clarified why the court may have construed his activities as the crime of harassment. I don't know where the court proceedings can be found but one of the links I posted in the previous page (tabloid, alas) goes into more detail and justify the application of UK laws prohibiting harassment and/or "malicious communications" (several people, several times, obscene communication where a reasonable person may attribute malicious intent, etc). At this point, if you have a problem with the legal aspects, you may be better served by trying to dig up the original court documents than by rhetoric.
I don't agree that it's a crime that should be punished with jail time. Even less so if this man has aspberger's. Of course, a diagnosis doesn't always constitute a valid defense of criminally antisocial behaviour (or all our prisons would probably be much roomier).
"One day, we shall die. All the other days, we shall live."
Are people here hiding behind the punishment being extreme in order to not address if this type of behavior should be illegal or not?

"In a field where an overlooked bug could cost millions, you want people who will speak their minds, even if they’re sometimes obnoxious about it."
Well I appreciate the thought, but you've obviously missed the point that "saying something someone doesn't like" isn't illegal. First of all, it's not "something someone doesn't like" - you can't just pick something someone says at random, decide you don't like it and have them imprisoned. It has to be something which is actually abusive or obscene. Second of all, you can still *say* it, what's illegal is putting it into a communication and sending it to the person in question.Well, when you get sentenced to jail because someone doesn't like what you said, do be sure to tell us. I'll visit and bring you a carton of fags, so you can buy protection from the fags.
You seem to think the law is written and implemented by a robot as envisioned by 1960s science fiction.

Odd that this real-life troll group doesn't get sent to jail. I can only guess why.

They're actually far worse. Not only is each of their acts blatant trolling, but they're trying to provoke a race war.
