    I don't find this bad news about free speech, while I have quite often in the past on issues brought up here. Harrassment in this instance has nothing to do with free speech.

    Not to mention the "several" pictures videos and messages were spread out over "several" dead kids. There's nothing to suggest he repeatedly targeted anyone in particular, but just went from one dead twit on Facebook to another.

    Good fences make good neighbors?

    Your parents have an expectation of people not to trespass. But I bet once someone does, they might consider it.

    Online, in a public social site, not so much of an expectation. Especially when you let any douchebag see it.

    How about if you don't want douchebags screwing with your Facebook page you make it private? This gonna sound like blaming the victim, but why on earth would you advertise the death of a family member on a public feed like this, knowing that their are trolls everywhere? This was served up to the public, almost begging to be targeted by a twat.

    Why exactly is it that we must make everything private just so the trolls cannot run amok? Fences everywhere, just so no one can take a dump on our garden? Mistrust anyone and everything just because some moron might come along?

    Instead of punishing people for their anti-social behavior? And, before you or someone else bring up this site again, please also consider that moderation on this site is non-existent.     Remind me what the typical punishment for anti-social behavior in Britain is. 18 weeks in jail, right?

    I believe the equivalent would be to go to a funeral, and when given the chance to speak, to say that the dead person was a rotten man. That should be punishable by jail, right?

    How about if I'm about to fire some of my employees, and to rub it in, send them an email telling them that they're fired and will probably starve to death. That should be illegal, right?

    Humans are petty creatures. What that law does is criminalize a huge portion of human behavior.

    If you really think that's the equivalent, then you're a moron. I don't know why we even need to come up with any kind of "equivalent" when we can just look at what he said and pretend he did it verbally or IRL instead of on facebook.

    Steely's clarified why the court may have construed his activities as the crime of harassment. I don't know where the court proceedings can be found but one of the links I posted in the previous page (tabloid, alas) goes into more detail and justify the application of UK laws prohibiting harassment and/or "malicious communications" (several people, several times, obscene communication where a reasonable person may attribute malicious intent, etc). At this point, if you have a problem with the legal aspects, you may be better served by trying to dig up the original court documents than by rhetoric.

    I don't agree that it's a crime that should be punished with jail time. Even less so if this man has aspberger's. Of course, a diagnosis doesn't always constitute a valid defense of criminally antisocial behaviour (or all our prisons would probably be much roomier).

    Well I appreciate the thought, but you've obviously missed the point that "saying something someone doesn't like" isn't illegal. First of all, it's not "something someone doesn't like" - you can't just pick something someone says at random, decide you don't like it and have them imprisoned. It has to be something which is actually abusive or obscene. Second of all, you can still *say* it, what's illegal is putting it into a communication and sending it to the person in question.

    You seem to think the law is written and implemented by a robot as envisioned by 1960s science fiction.
