Not that I'm a fan of the feds, or the supremacy clause in general, but this does seem like one of the uncommon instances in recent memory where it's actually applicable and not just the fed-speak for "we get to do whatever the fuck we want to." Or am I missing some reason that the state of California charging $30 tax on a free handset is a valid reason to bring a massive class action lawsuit against AT&T?

Granted companies abuse the hell out of arbitration clauses in... everything, but it's hard to blame them when every jackass with a $30 dispute against a 3rd party tries to parlay it into a multi-million dollar lotto ticket against a big corporation.

I can't check from work, but are you viewing that from the search results, or the product page? last I heard it was going to be free till at least Monday, and Steam resets their sales midday, so you should have at least a few more hours. I know the search page still lists the full price, but if you went all the way to the product page the button that used to list the price says install game instead (meaning its free).

I'm not particularly familiar with the plaintiffs claims. I don't really give a rat's ass about the particulars of most cases. Those might be right or wrong on their merits and the courts *and juries* can respond to them as such. The merits of a case have next to nothing to do with the procedural/constitutional issue SCOTUS addresses.

Except that by the time a piece of shit like this reaches a jury or makes it into the courts, the system's already failed, on account of how expensive it is to defend one's self against even a completely baseless lawsuit. But fine, how was the SCOTUS wrong in applying the supremacy clause here?

    Anyone played The Witcher 2?

    Looks pretty. And pretty good.

Steam have it at a reduced price so thinkin about it.

Everything I've heard is that its a solid game. Steam has it for $29.99 right now over here, but its cheaper as an Amazon download, $23.99. If you wait a week you can support the developer directly and get it from gog.com for $29.99

I want the physical box, it comes with so much stuff that I miss finding in game boxes.

There are a few hours left in Steam's SEGA sale. A few classics for only a couple of bucks, like Crazy Taxi and Bass Fishing. Sonic games for less than a bottle of soda, and some DLC for la-cheap for more recent games like Aliens vs Predator.

Can't wait for the soon to be released RPG of the year!

Sorry Todd Howard, but that would be Dark Souls, not Skyrim, though if it's any consolation, Skyrim will sell better, and Dark Souls will be sadly overlooked.

Anyway, playing Demon's Souls right now in anticipation.
Shame people can't look past the brutal difficulty..they miss out the rewarding satisfaction that comes with overcoming it.

I'm not entirely sure I would call that one an RPG. Action Adventure would be more like it.

I would call it an RPG with action-adventure style combat.

It has the storyline, fantasy setting, loot, levels, health bars, mana bars, dungeons, stats to level up, grinding, NPC's, questing, etc of a typical RPG.
To be honest, I find it deeper than a lot of other RPG's out there.

I suppose it depends how one defines that genre...in my mind it ticks all the important boxes, and then some.

    Have you played it Khen?

I don't play console. I don't like the kind of dumbing down a console game inspires.

So played it for a good many hours now.

    It is indeed solid.

Very lush and impressive in its setting.

Adult themes, dark and involving plotline.

But combat, on normal difficulty, is oh so oh so oh so tough, particularly at the beginning. Some battles I've died and reloaded, died and reloaded, up to thirty times, trying different tactics and approaches to win.

Now that my stats are a bit higher it is a little more forgiving, but geez.

I've heard that beginning is rough, not sure how much they changed that in the 2.0 version they just released.

Finally got around to Indigo Prophecy aka. Fahrenheit. Looks like just the sort of game I love, but goddamnit the controls are irritating damn consoles.

Anyone pick up Rage today? Heard its not doing to good on the PC, that article from over the summer with Carmack admitting treating consoles with equal development time was a mistake is starting to make sense now.

Sony isn't exactly what you would consider consistent when it comes to solid advertising, but when they get it right, its amazing.

^^ Yeah, I picked up Rage.

Got it on console though..textures seem to pop in a bit too often, but it sure is a pretty game.
Gameplay seems decent, Borderland-ish quest style, fetch and kill..nothing special.

Haven't played enough to decide yet.

Joystiq, RockPaperShotgun and Ars Technica all pretty much give Rage a "meh" and call it a pretty tech demo.

Portal 2 - as good as the first, which is a pleasant surprise.

$10 is still to much. I managed to play a few levels a few weeks ago, bitterly disappointed - especially when you consider how much development time they had.

There released a patch that addresses some the shortcomings, like weapon limits and such. Doesn't do much to fix the bland gameplay, but the game is a bit better than it was at release.

I've never played a Duke game, and I'm not a big fan of FPSers, but I managed to play through it, amused by the toilet humor and swipes at other games, took me 15 hours on the easy setting. Not worth the ~$50 I paid for it at launch, but $10 don't seem to bad.

I liked the original Dukes when I was young, but to be perfectly honest DNF sounds shit.

Got a new game today: Dawn of Fantasy - an MMORTS

Never heard of an MMORTS as opposed to an MMORPG, so far seems fun. To be fair, never played an MMORPG either actually, I hate the idea of subscription costs and despite paying for Guild Wars its still sat in its original wrap never even installed.

Guild Wars still has an active base, and they are still adding content into the game, even more so now, bridging the gap between the originals and GuildWars 2.

Its got a hell of a learning curve, but its playable by Forever Alones as well.
